The following bills were approved in the NYS Senate.  Senator Gallivan's vote is noted.

S641A Creates a new section 66-x in the public service law to establish a weatherization program that will developed by utilities and the PSC. The utility shall create a pilot program.  AYE

S3111 Permits the principal of any high school to allow any local fire department, upon request, to enter the school for the purpose of fire department junior recruitment, including, but not limited to: making presentations; disseminating literature; and answering questions by students. AYE

S3799B Establishes a framework for property owners to make improvements and repairs that require access to adjoining property, and the rights of the adjoining property owners. AYE

S4728A Establishes the New York state Cryptocurrency and blockchain study task force (the task force). This task force would provide the governor and the legislature with information on the widespread use of cryptocurrencies and other forms of digital currencies and their ancillary systems, including blockchain technology in the state.  AYE

S5049 This bill would amend section 2108 of the insurance law, regarding licensing of independent insurance adjusters, to waive requirements regarding character references and a written examination, if the applicant holds a claim certification from a national or state-based claims association, and such program meets certain high end requirements.  AYE

S3819A This bill increases penalties for landlords of multiple dwellings with more than ten units who are in violation of the uniform fire prevention and building code who have failed to comply with an order to remedy.  NAY

S6165 This is a sunshine bill that would require Department of State to electronically transmit a copy of every certificate of incorporation that has been filed on behalf of a municipal corporation, state or local authority or district. NAY (Limits local decision making related to LDCs.)

S6831 Requires the owner or operator of a major facility or a vessel to establish and maintain with the department evidence of financial responsibility sufficient to meet the amount of liability. AYE

S6600A This bill requires the inspection of non-fireproof buildings every three years, it also requires that dwelling not in compliance with New York City Housing Maintenance Code make repairs within six months.  NAY (Negative impact on property owners.)

S6718B Prohibits the imposition of any surcharge for the installation or use of a tenant-installed appliance where the tenant pays for electric utility service, under rent control, and rent stabilization laws in the City of New York. NAY (Additional rent control.)

S6181 This bill would amend the Cannabis Law to clarify that employment at any licensee under the Cannabis Law satisfies employment requirements for parole, probation or other state supervision unless the terms and conditions of said parole, probation, or state supervision explicitly prohibit such employment. NAY (Takes decision away from parole officer.)

S6390 Requires the commissioner of corrections and community supervision to make correctional facility water testing results accessible directly to incarcerated individuals and correctional facility staff in such facilities and make such water testing results available to the public on the website of the department.  AYE

S6426 Authorizes the assistant court clerk and fire marshal of the town of Harrison, county of Westchester, to be nonresidents of such town. AYE

S6928 Permits the county of Erie to market serial bonds at private sale through the sunset date. AYE

S6068 Requires the creation of an annual report on the race and ethnic data of individuals who have taken civil service exams. AYE

S6745 Requires the SUNY and CUNY trustees to produce an annual report for their respective state-operated institutions'/senior colleges' and community colleges' campus foundations and research foundations in a standardized format. AYE

S1349B Requires school districts to provide information regarding water safety and swimming certification to certain parents or students upon enrollment; relates to promoting public awareness of the dangers of fatal and non-fatal drowning.  AYE

S6133 Requires the office for the prevention of domestic violence to conduct a study on domestic violence in the transgender community with a focus on Black transgender women.  AYE

S5452 Requires a commissioner to meet certain qualifications before his or her appointment which shall include, but not be limited to, the qualifications prescribed by section three of the public officers law, and demonstrated experience in election administration or other management, operations, or administrative experience in the public, non-profit, or private sector as deemed sufficient by the board. NAY

S7694 This bill amends CPLR 4518 to clarify that for the business records exception to apply to a writing or a record, the judge must find that 1) the writing or record was made upon the recorder's personal knowledge or from information given to the recorder by a person with personal knowledge and a business duty to transmit the information accurately, or from information received by the recorder which itself is subject to an exception to the rule barring the admission of hearsay; and 2) for a hospital record, the entry must also be germane to the patient's treatment or diagnosis. NAY (Restricts access to medical records. Judge should decide.)

S7696 Provides that any person who has served as a state-paid judge or justice of a court of the unified court system or as a housing judge of the housing portion of the civil court of the city of New York, but who no longer holds any of such offices, may apply to be designated as a judicial hearing officer. AYE

S7735 Permits amendment of a claim or notice of intention to file a claim to correct jurisdictional pleading defects and the dismissal of a claim based upon claimant's failure to comply with jurisdictional pleading requirements. AYE

S5758 Provides that in the city of Rochester plumbing inspectors shall be citizens and residents of the county in which the city is located. AYE

S7702 Provides that in the city of Rochester plumbing inspectors shall be citizens and residents of the county in which the city is located for an additional three years through August 15, 2028. AYE

S982 Adds Fishkill Creek in Dutchess County to the definition of inland waterways.  AYE

S7767 Extends provisions of law relating to the authority of the department of environmental conservation to fix by regulation open seasons, size and catch limits and manner of taking fish from December 31, 2025 until December 31, 2028. AYE

S7768 Extends the authority of the department of environmental conservation from December 31, 2025 until December 31, 2028 to adopt by regulation measures for the management of hard clams, soft or steamer clams or razor clams. AYE

S7769A Extends the authority of the department of environmental conservation to manage oysters from December 31, 2025 to December 31, 2027. AYE

S7770 Extends, until December 31, 2028, DEC's authority to fix by regulation measures for the management of alewife (Alosa pseudoharengus). AYE

S7771 Extends the authority of the department of environmental conservation to manage American shad until 12/31/2028. AYE

S7772 Extends the authority of the department of environmental conservation to manage weakfish until 12/31/2028.  AYE

S7773 Extends the authority of the department of environmental conservation to manage bluefish from 2025 to 2028. AYE

S7774 Extends, until December 31, 2028, DEC's authority to fix by regulation measures for the management of hickory shad (Alosa mediocris). AYE

S20 Allows out of state health care professionals to perform services at the Ironman Lake Placid 2025. AYE

S4585 This bill seeks to expand continuing care retirement communities (CCRCs) throughout New York. The bill amends the establishment of the CCRC council to repeal it and to establish a continuing care retirement community council and authorize the Commissioner to satisfy some of the duties. AYE

S7408 This bill would prohibit food service establishments from refusing a customer’s request to package their beverage or food leftovers in a reusable food container provided by the customer instead of using the disposable food service container provided by the establishment. NAY (Places onus on businesses to determine cleanliness of the reusable containers.)

S537 Authorizes the county of Nassau assessor to accept an application for a real property tax exemption from Gurdwara Guru Tegh Bahadur Sahib, Inc. for all of the 2023 general taxes and all of the 2022-2023 school taxes.  AYE

S4325 Authorizes Powell House, in the village of Farmingdale, county of Nassau, to apply for and receive a retroactive property tax exemption with respect to the 2024-2025 school tax assessment rolls and the 2025 general tax assessment roll. AYE

S6330 Defines therapeutic agriculture and clarify that it is eligible for grants and other benefits which are currently available to community gardens and their operations. AYE

S6822A Prohibits contracts for the purchase or financing of a dog, cat, or rabbit from including provisions allowing repossession of the animal; provides that such provisions apply to the sale of dogs, cats and rabbits through an online website.  AYE

S6044 Exempts the South Onondaga Fire Department within the town of Onondaga, Onondaga county, from the requirement that the percentage of non-resident fire department members not exceed forty-five percent of the membership. AYE

S7204 Exempts the Caughdenoy Volunteer Fire Department, Inc., within the town of Central Square, Oswego county from the forty-five percent limit on non-resident members. AYE

S6217 Amends the Workers' Compensation Law by raising the limit for treatment costing less than $1,000 to $1,500 to be done without prior approval and clarifying that the list of pre-authorized procedures shall be issued and maintained solely for the purpose of expediting authorization of treatment of injured workers and not be used as a basis for denying treatment not contained therein.  AYE

S6367 Extends the expiration date of free one day admission to the zoological park to December 31, 2030. AYE

S6903A Designates the Scajaquada heritage area as a state designated heritage area. AYE

S7469 Establishes harassment of a child in the 1st degree (a class A misdemeanor) when the perpetrator intentionally or knowingly harasses, annoys or alarms a child or a child's parent or guardian; establishes a private right of action for harassment of a child. AYE

S6416 Allows Oak & Reed, a restaurant in the City of Middletown, to obtain a retail license for on-premises consumption despite being within 200' of a building occupied as a school or place of worship. AYE

S6417 Allows The Taco Factory, a restaurant in the City of Middletown, to obtain a retail license for on-premises consumption despite being within 200' of a building occupied as a school or place of worship. AYE

S6418 Allows Piccolo Cucina e Vino, a restaurant in the City of Middletown, to obtain a retail license for on-premises consumption despite being within 200' of a building occupied as a school or place of worship. AYE

S7858 This bill seeks to restore to the Senate full and proper advice and consent power regarding nominations of chief executive officers of the NYS Dormitory, NYS Thruway Authority, New York Power Authority, and the Long Island Power Authority.  AYE

S7193 Extends the effectiveness of the New York black car operators' injury compensation fund, inc., for an additional three years. AYE

S79 Requires that all special education students attending schools scheduled to be closed or to undergo a significant change be assigned to new schools prior to the implementation of the closing or change. AYE

S1510 Allows the president of the citywide council on high schools to participate in the selection of the members of the board of education elected by the community district education council presidents. AYE

S1311 Authorizes Jonathan Montalvo to be placed on the eligible list for employment for the state university of New York police. AYE

S180A This bill would increase the SSI Enhanced Residential Care Monthly rate from $1,608 to $1,768 per month or by 10 percent.  AYE

S244 Establishes a fiscal cliff task force to conduct a study on fiscal cliffs in the state's public assistance programs and to make recommendations related thereto. AYE

S247 Provides for the licensing of vision impairment specialists.  AYE

S520 This bill would establish that any person with a history of ovarian cancer shall not be denied genetic testing or genomic tumor profiling for inherited germline mutations and acquired somatic mutations. AYE

S983 This bill would extend the provisions of law authorizing an individual to fish with up to three lines in freshwater until December 31, 2027. AYE

S1063 Requires cultural awareness and competence training for medical professionals, including two hours of course work encompassing minority healthcare issues.  NAY (No evidence necessary. Cost exceeds benefit.)

S1072 Directs the state education commissioner to require public school districts to report on compliance with art education instruction requirements. AYE

S1140A This bill would amend the tax law to add a new Article 12- B, which would establish a tax on noise from non-essential helicopter and seaplane flights in cities with a population of one million or more. NAY

S1171 Establishes a town of Huntington deer management pilot program.  AYE

S1197 Requires daycare facilities to maintain evacuation & lockdown plans for children with disabilities during an emergency situation. AYE 

S1200 COSPONSOR Allows the granting of academic credit at state or city operated institutions to veterans. AYE

S1366 Directs the commissioner of the office of mental health to promulgate rules and regulations prohibiting any suicide prevention or mental health services hotline operated or sponsored by the state from being automated. AYE

S1477 Relates to the purchase of claims by corporations or collection agencies; relates to the inference of an assignee's intent and purpose in taking an assignment of a claim against an obligor that is not an eligible obligor. NAY

S3334 Requires the commissioner to establish Asian American, Native Hawaiian, and Pacific Islander history and civic impact curriculum or instructions for school districts.  AYE

S4776 COSPONSOR Adds falsely reporting the use of a deadly weapon or dangerous instrument as part of the crimes of falsely reporting an incident in the first and second degrees. AYE

S5228 Directs the office of children and family services to establish a center for fatherhood initiatives to issue grants to any and all initiatives regarding the promotion and advancement of fatherhood, including but not limited to all marginalized fatherhood groups to help expand opportunities to improve parenting knowledge, attitudes, and self-efficacy.  AYE

S5407A Establishes the "first responder peer support program act" which supplies peer-to-peer mental health programs to first responders. AYE

S5685 Changes the official name of the Staten Island Expressway to the "POW-MIA Memorial Highway". AYE

S6232 This bill would direct the Commissioner to create and operate a prenatal and postpartum informational membership-based mobile application to be made available to birthing individuals who are eligible for Medicaid. AYE

S7203 This bill enacts the tropical rainforest economic & environmental sustainability act requiring that companies contracting with the state do not contribute to tropical forest degradation or deforestation directly or through their supply chains; establishes the supply chain transparency assistance program to assist small and medium-sized businesses and minority and women owned businesses in achieving compliant supply chains. NAY

S2462A Establishes the Public Renewables Transparency Act.  AYE

S4559B Requires the appointment of a Title VI coordinator at every college and university in the state to ensure compliance with Title VI of the federal civil rights act of 1964; requires the division of human rights to develop training for students and employees; requires the Title VI coordinator to notify annually all students and employees of the institution's policies and procedures for reporting discrimination and harassment. AYE

S5989A Requires school districts to establish a method by which a parent may request a local library card for their minor child on the school registration form.  AYE

S5553B Enacts the "rate hike notice act" which requires utilities in the state of New York to provide notice of a proposed rate hike to a customer via text, email and via such customer's monthly billing statement. AYE

S7165A  Authorizes the public service commission to consider noneconomic loss suffered by consumers, including pain and suffering or mental anguish, when determining penalties against a public utility company, corporation or person or a combination gas and electric corporation. NAY (Too broad.)

S7532 Enacts the restriction of anticoagulant pesticide transactions for online and retail stores act to prohibit any person from selling, offering for sale or use, or distributing within the state, any second-generation anticoagulant rodenticide; prohibits the use of either a first-generation anticoagulant rodenticide or a second-generation anticoagulant rodenticide within five hundred feet of a wildlife habitat area. AYE

S7416A Allows for the execution of wills to be done electronically by enacting the Uniform Electronic Wills Act. NAY (Too much exposure to potential fraud.)

S7525A Extends the authorization to impose a county recording tax on obligations secured by a mortgage on real property in Albany County. AYE

S7151A COSPONSOR This legislation amends the Public Health law governing waiting lists for organs to remove statutory language, first codified in 1990, that precluded persons from submitting requests to be placed on waiting lists with multiple organ procurement organizations, designated to serve any part of New York State, for an organ transplant.  AYE

S6705 Provides that students who receive a high school diploma from an online high school program located within the United States that is accredited in accordance with the Job Corps Policy and Requirements Handbook shall be eligible for admission to colleges and financial aid. AYE

S7220 Relates to continuing education requirements for landscape architects; provides that adjustments to such requirements may be granted for health reasons, active duty, or other good cause; limits the number of credit hours that may carry over to the next registration period. AYE

S6799 Prohibits a court from bifurcating the primary elections for members of the state and county committees and assembly district leaders and associate district leaders and all other party positions to be elected and all nominations for public office required to be made at a primary election in such year, except presidential primaries. NAY

S6996 This bill would change the dates of petition filing to allow observant Jewish candidates and staff to file without interfering with Passover. AYE

S5675 Requires a petition in a summary proceeding to recover possession of real property in the city of Schenectady to allege proof of compliance with local laws requiring rental residential property registration and licensure.  AYE

S6128 This bill amends the CPLR to provide that when a writing, an object, or other material is used to refresh a witness's recollection for the purpose of testifying at a trial, hearing or deposition, then an adverse party is entitled to inspect the writing, object, or other material at that time, except as otherwise provided by law in criminal proceedings. NAY 

S7279 Authorizes certified school psychologists to participate in the certification of certain persons as intellectually disabled or developmentally disabled; makes technical corrections to language. NAY (To low of bar to take away civil rights.)

S7486A Qualifies the permitted use of proceeds from the lease of lands located at the state university of New York at Purchase shall go to New York state resident students who are eligible to receive a federal Pell grant. AYE

S7681 Prohibits a state or local authority, or subsidiary thereof, from retaining, contracting, employing, or designating a lobbyist to engage in lobbying; allows for the cancellation of pre-existing contracts.  AYE

S7718 Establishes the "Whale Strike Prevention Act." Beginning in 2027, every commercial vessel 500 ft or more in length shall maintain a whale interaction prevention policy and submit it to the DEC or the Port Authority. NAY (Onerous penalty structure.)

S7200B This bill authorizes and directs the Commissioner of the DMV to develop and issue a special vintage registration for snowmobiles manufactured more than 30 years ago.  AYE

S6200 Requires utility companies, LIPA, cable TV companies, internet companies or municipalities rendering utility services to maintain a toll free number for consumers to call to report service outages which shall be made available 24 hours a day, 7 days a week. AYE

S7238A Increases the number of commissioners of the public service commission to eight; requires the commission to have a duty to protect public interest, including ensuring access to utility services for residential and business customers; prohibits commissioners from having been employed within the last two years by an electric, gas, steam, telecommunications, or water utility that is regulated by the commission. NAY (Unnecessary.)

S7693 Provides that gas, electric, or combination gas and electric corporations shall not be permitted to retain revenues derived from their actual return on equity in excess of authorized rates of return on equity. AYE

S7359A Directs the commissioner of agriculture and markets, acting by and through the department of economic development, in cooperation with the department of environmental conservation, to establish a New York native plants designation, and offer seals or logos identifying native plants as grown in New York state and certified for their quality, for product labeling, advertising, and displays. AYE

S6757 Clarifies that the opioid settlement agreement must include settlements and releases related to any entities involved in the prescription drug marketing, supply and payment chain that may have contributed to the opioid epidemic through their illegal conduct. NAY (Takes away local control and vests too much power in the state.)

S1172 Requires towers to clean up any debris in the surrounding area resulting from the vehicles they are towing and tow trucks to be equipped with the appropriate equipment for such clean up efforts. AYE

S6723 Requires that hair relaxer products display labels when they contain certain dangerous chemicals. AYE

S7483 Requires the department of state to make renewed appearance enhancement licenses and certificates and renewed barber licenses and certificates available on its website in a portable document format for download by the person whose license or certificate has been renewed. AYE

S7585 Authorizes owners of mobile barber shops to obtain barber shop owner's licenses provided that they can furnish proof of proper layout, adequate equipment for the shop, sanitary conditions in the shop and good moral character. AYE

S7612 Directs the Office of Temporary and Disability Assistance (OTDA) to create a statewide "co shelter toolkit" to help shelters accommodate individuals and their companion animals together. AYE

S4323 This bill would add a new Article to the Banking Law titled "Uniform Special Deposits Act". A special deposit is defined as a deposit of money at a bank which is to be disbursed for a permissible purpose to a designated person (the beneficiary), only after a specified even or contingency has occurred. AYE

S7616A Directs the state university trustees, without any public bidding, to lease and otherwise contract to make a portion of the lands of SUNY Stony Brook on its campus to the Stony Brook Housing Development Corp. for the purpose of building undergraduate student, graduate student, faculty and staff housing; limits such lease to a period not exceeding 100 years. AYE

S6991 Amends section 2-b of the Religious Corporations Law to exempt the Greek Orthodox Archdiocese from having to provide notice to the Attorney General when it is seeking court approval for the disposition of its assets.  AYE

S7685 Amends the New York Real Property Tax Law to increase the tax abatement for childcare centers in cities with populations over one million.  AYE

S548 Authorizes the state to convey certain forest preserve land; provides such sale shall be subject to legislative approval and the proceeds of such conveyance shall be used for acquisitions to the forest preserve. AYE

S3340 This bill would decouple the New York State tax treatment of gains from qualified opportunity zones in calculating taxable income from the Federal Tax Code.  NAY (Tax increases for some.)

S7152A Empowers the council on the arts to designate the Harlem Renaissance Cultural District. AYE

S6756A Includes not-for-profit corporations and public television or radio corporations in the definition of business entity; allows such entities to claim the newspaper and broadcast media jobs tax credit. NAY (Allowing refundable tax credits to entities not subject to income tax may set a challenging precedent.)

S7645 Authorizes Duane Lake, in the town of Duanesburg, county of Schenectady, to participate in the septic system replacement fund. AYE

S8199 Directs the department of financial services to conduct a study on the banking development district program and to make recommendations to improve such program. AYE

S7484A Establishes a statewide residential families committee within the developmental disabilities advisory council. AYE

S7793 Requires the developmental disabilities advisory council to submit an annual report to the governor, temporary president of the senate and the speaker of the assembly on the activities of the council, and to make such report public. AYE

S7944 This bill amends the Labor law related to certain provisions on elevator licensing and temporary elevator mechanics. NAY (Onerous penalty structure.)

S2611 The bill permits participation in bingo games by minors (under 18 years of age) who are accompanied by an adult. AYE

S2612A Relates to horsemen's health, welfare, pension and administrative benefits for harness racing licensees.  AYE

S379A The bill requires the commissioner of education to establish the FIRST grant program and the FIRST robotics competition. AYE

S462A This bill would permit audio-visual coverage of court proceedings by the media subject to certain limitations provided by the presiding trial judge overseeing such proceedings. AYE

S1204 Directs the metropolitan transportation authority and the New York city transit authority to rename the 110th Street - Central Park North subway station to the 110th Street - Malcolm X Plaza station. AYE

S3180 Provides the director of the office for the aging to develop a program to train senior service providers in detecting and reporting elder abuse. AYE

S3458 Provides that beginning in the 2026-2027 academic year, certain graduate students shall be required to pay 25% of all current and future mandatory university fees; provides that in the 2027-2028 academic year and thereafter, no mandatory university fees shall be charged, with the exclusion of the graduate student association student activity fee. AYE

S1009 Authorizes a veteran's close friend or family who is reasonably familiar with such veteran's wishes to request that such veteran be buried in a state veterans' cemetery.  AYE

S1636 Authorizes the city school district of the city of Salamanca to establish a reserve fund for federal impact aid in the event such aid is reduced.  AYE

S335 This bill would specify that any actions or practices which attempt to establish a monopoly or monopsony are illegal and void. NAY (May unintentionally apply to and hurt medium sized corporations.)

S3308 Provides for the reinstatement of state recognition and acknowledgement of the Montaukett Indian Nation; provides that the Montaukett Indian nation shall have a chief or sachem, three tribal trustees and a tribal secretary; provides for the qualification of voters; makes related provisions. AYE

S31 Provides that the thruway authority shall issue permits for ambulances and fire vehicles exempting such vehicles from paying tolls on the thruway when engaged in an emergency operation. AYE

S416 This bill would make all law enforcement agencies make radio communications accessible in real time to emergency services organizations and professional journalists. NAY (Could potentially jeopardize the safety of police officers.)

S680 Requires NY-Alerts to be issued within thirty minutes of a disaster or state disaster emergency or as soon as practicable. AYE

S1398A The bill creates a new article in the private housing finance law to establish the Block by Block Homeownership Program.  AYE

S2046 Establishes the mental health educational opportunity program and the mental health higher educational opportunity program to provide additional educational opportunities for students at certain universities and colleges in the state to enroll in academic programs that lead to a degree or degrees required for licensure in any of the mental health professions. NAY (Carves out a financial aid exception for students without any lawful immigration status.)

S3157 Authorizes a licensed dental hygienist, collaborative practice to provide services without supervision in collaboration with a licensed dentist under a collaborative practice agreement.  AYE

S3278 Provides for the licensure of school psychology practitioners; authorizes the use of the title "licensed school psychology practitioner" to licensed or exempt individuals; defines practice of licensed school psychology practitioners; sets forth requirements for professional licensure (including educational attainment, experience, exam and fee); provides for issuance of limited permits under specified circumstances; identifies exempt persons.  AYE

S3398 This bill amends subdivision 7 of section 296 of the Executive Law to provide that it shall be an unlawful discriminatory practice to retaliate against an individual for requesting a reasonable accommodation. AYE 

S3416D Authorizes a practitioner in any institutional dispenser to administer controlled substances for use off their premises, as emergency treatment to a patient as authorized by the FDA for purpose of initiating maintenance treatment, detoxification treatment, or both to an addict or habitual user.  AYE 

S3883A This bill authorizes EMT-paramedics, acting within their scope, to administer controlled substances for use by a person with a substance use disorder or habitual user, to relieve acute withdrawal symptoms. AYE

S4929 Requires one caregiver for every two children under eighteen months of age in group family day care homes and family day care homes. AYE

S5220 Extends limitations on the shift between classes of taxable property in the town of Clarkstown, county of Rockland for an additional year. AYE

S7967 Includes the Island Park Public Library as an eligible library for the financing of projects through the dormitory authority. AYE

S 2460 Authorizes the secretary of state to appoint a person from the utility intervention unit within the consumer protection division to serve on the state energy planning board.  AYE

S8062 Establishes the. Usage Monitor Program to notify electric and gas utility customers when their usage has exceeded a threshold set by the customer.  AYE

S8213 Requires utilities to fully describe their capital expenditures in rate cases and requires the burden of proof to show that a capital expenditure is just and reasonable be on the utility. AYE
